Working Groups

The Property Law Reform Alliance has established six working groups that are examining different aspects of property law. 

These working groups are:

Conveyancing

Chair:  Margaret Hole

Purpose:  The Conveyancing Working Group is responsible for examining conveyancing laws and practices around Australia and recommending leading practices that could be adopted nationally. 

Current Projects:  The Working Group has prepared an options paper which explains decisions made for each of the matrices. 

Issues for Consideration:  The relevance of standard contracts and the degree to which information needs to be consistent.

Chair:  Dennis Bluth (Acting)

Purpose:  The Documentation Working Group is responsible for identifying documents used in the sale and transfer of property throughout Australia and making recommendations on areas where national consistency might be achieved. 

Current Projects:  The Working Group is currently developing a matrix of disclosure requirements for residential property. 

Issues for Consideration:  The content of disclosure documents is continuously changing, which has forced the Working Group to limit its focus for the time being.

Leasing

Chair:  Eva Oraham

Purpose:  The Leasing Working Group is responsible for identifying and promoting leading practice approaches to lease law, registration, and the imposition of stamp duty on leases. 

Current Projects:  The Working Group has prepared an options paper which explains decisions made for each of the matrices. 

Issues for Consideration:  In order to limit the number of issues the Working Group needed to cover, a decision was made early in the process not to deal with retail law.

Leasing Options Paper

Powers of Attorney

Working Group has been disbanded

Purpose:  The Powers of Attorney Working Group is responsible for considering the treatment of powers of attorney as they relate to property transactions. 

Current Projects:  The Working Group has been developing a discussion paper on leading practice in the registration of powers of attorney.  This will be finalised soon. 

Issues for Consideration:  None at this stage.

Professional Standards

Chair:  Tony McNamara

Purpose:  The Professional Standards Working Group is responsible for identifying nationally consistent leading standards for: 

  • education and training; and
  • licensing requirements

for professionals involved in the sale of property and associated activities. 

Current Projects:  The Working Group is currently establishing the scope of its work programme. 

Issues for Consideration:  None at this stage.
